In 2008, former underworld fugitive Graham Gene Potter is alleged to have conspired to murder two men.

He was arrested in February after more than a decade on the run and on Thursday a Melbourne magistrate released details of allegations against him.

Police uncovered Potter’s hiding place in Cairns after 12 years of searching for the 64-year-old.

He was flown back to Melbourne where a magistrate revealed the court had no paperwork and the case was in archive because of its age.

Details of four charges were released on Thursday.

It’s alleged between January and August 2008 Potter conspired with Pasquale Barbaro to murder Fedele D’Amico and between June and July that same year he conspired with Barbaro and Francesco Madafferi to murder Michael Barbaro.

Commonwealth prosecutors allege between January and August 2008 Potter trafficked MDMA.

He is also charged with failing to appear in court on bail on February 1, 2010. He had been released on May 28, 2009.

Potter remains in custody and has not sought to be released on bail again.

On his return to Melbourne, Potter said he spent his time on the run “living life” and “avoiding being killed”.

“You’d appreciate I can’t talk, I’d like to, but I can’t at this stage,” he said.

He is due back in court on June 16.
